Welcome to Muze. These Terms and Conditions (“Terms”) govern your use of www.muze.co.za (the “Website”) and any orders you place with us. Please read them carefully. By accessing the Website or placing an order, you agree to be bound by these Terms.

These Terms must be read together with our Returns Policy, Privacy Policy, and Shipping Policy, which are incorporated into these Terms by reference.

In these Terms, “we”, “us”, “our”, and “Muze” refer to Inspo Brands (Pty) Ltd. “You” and “your” refer to the person using the Website or placing an order.

2. Acceptance and use of the Website

2.1. By using the Website you confirm that you are at least 18 years old, or that you are using the Website with the consent and supervision of a parent or legal guardian.

2.2. You agree to use the Website lawfully and not to use it in any way that infringes the rights of any other person or that restricts or inhibits any other person’s use of the Website.

2.3. We may suspend or terminate access to the Website at our reasonable discretion, including where we suspect fraudulent activity or breach of these Terms.

3. Orders, prices, and payment

3.1. Each order placed through the Website is an offer by you to purchase the goods described at the prices shown. A binding contract is formed when we send you a written order confirmation by email. Until that point, we may decline an order at our discretion (including, without limitation, for stock or production-capacity reasons or where pricing is incorrect).

3.2. Prices are quoted in South African Rand (ZAR) and are inclusive of VAT where applicable. Delivery fees, where they apply, are shown at checkout or communicated to you in writing before dispatch. We do not charge any additional fees beyond the price displayed and the delivery fee disclosed.

3.3. We offer a 50/50 payment plan for custom orders:

  • A 50% deposit is payable at checkout to confirm your order and reserve your production slot.
  • The remaining 50% balance is due before delivery or collection, once your piece is complete and ready to dispatch.

3.4. Payment is processed securely by our third-party payment partners (including Ozow and other PCI-DSS compliant providers). We do not store your card or banking details on our servers. We accept payment by major credit and debit cards, instant EFT, and direct EFT. For larger orders we may also accept bank transfer on request.

3.5. If the balance payment is not received within 30 days of your order being completed, we may, on written notice to you, cancel the order and retain the deposit as compensation for materials, labour, and the production slot reserved for you. We will give you a reasonable opportunity to settle the balance before doing so.

3.6. Before placing your order you will have an opportunity to review the order, correct any errors, and withdraw from the transaction, in line with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

4. Lead times and delivery

4.1. Muze furniture is made to order. Our standard lead time is approximately 4 weeks from receipt of your deposit. Lead times are estimates and may vary depending on order volume, fabric availability, and external factors beyond our control.

4.2. We deliver throughout South Africa. Delivery costs are calculated at checkout or communicated to you before dispatch.

4.3. Risk in the goods passes to you on delivery. Ownership in the goods passes to you on receipt by us of payment in full, including any delivery fees.

4.4. Where delivery is delayed by a third-party courier or by an event of force majeure (clause 9), we will keep you informed and use reasonable efforts to minimise the delay, but we are not liable for losses caused by the delay itself.

5. Returns, cancellations, and cooling-off

5.1. Our full returns and cancellation rules are set out in our Returns Policy, which forms part of these Terms.

5.2. In summary: orders may be cancelled within 48 hours of placement (and before production has begun) for a full deposit refund. Damaged or defective items must be reported within 7 days of delivery. Because Muze furniture is custom-made to your specifications, we cannot accept returns for change of mind once production has commenced.

5.3. The seven-day cooling-off period under section 44 of ECTA does not apply to our products. Section 44 expressly excludes goods that are “made to the consumer’s specifications” or “clearly personalised”, and all Muze furniture is made to your specifications.

5.4. Nothing in these Terms or in the Returns Policy limits any right you have under the Consumer Protection Act 68 of 2008 (CPA). Where these Terms or the Returns Policy conflict with the CPA, the CPA applies.

6. Product information and customisation

6.1. Every Muze piece is custom-made. Product images, fabric colours, and finishes shown on the Website are for reference only. Actual products may vary slightly due to screen settings, lighting, the natural variation of fabrics, leathers, and woods, and the handcrafted nature of our work.

6.2. We are happy to provide fabric swatches, sample finishes, and confirmation drawings before you place your order. Please email hello@muze.co.za to request these.

6.3. You are responsible for the accuracy of the dimensions and specifications you provide at the time of order. We will use them as the basis for production.

7. Lifetime Frame Guarantee and warranty

7.1. All Muze furniture is covered by our Lifetime Frame Guarantee against frame defects in workmanship and materials, under normal domestic use.

7.2. Upholstery, fabrics, and finishes are covered by a 1-year warranty against manufacturing defects under normal domestic use. The warranty does not cover wear and tear, misuse, accidental damage, or failure to follow our care instructions.

7.3. To start a warranty claim, email hello@muze.co.za with your order number and details. These warranties are in addition to, and do not limit, your rights under the CPA.

8. Limitation of liability

8.1. To the fullest extent permitted by law, Muze will not be liable for any indirect, incidental, consequential, or special loss or damage arising out of or in connection with your use of the Website or the goods, including without limitation loss of profit, loss of use, or loss of data.

8.2. Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by our negligence, fraud, or any liability under sections 53 to 61 of the CPA.

8.3. Subject to clause 8.2, our total liability for any claim arising out of or in connection with an order is limited to the price paid by you for that order.

9. Force majeure

We are not liable for any failure or delay in performing our obligations under these Terms where the failure or delay results from any cause beyond our reasonable control, including (without limitation) acts of God, fire, flood, severe weather, civil unrest, strikes, pandemic, load-shedding, port or transport disruption, or failure of a third-party supplier.

10. Intellectual property

10.1. All content on the Website — including text, logos, designs, photographs, illustrations, drawings, and 3D model files — is owned by Inspo Brands (Pty) Ltd or its licensors and is protected by South African and international copyright and trade mark law.

10.2. You may not copy, reproduce, distribute, modify, publish, or commercially exploit any part of the Website or its content without our prior written consent.

10.3. Trade Program assets: Members of our Trade Program may use 3D model assets and related specification material we provide solely for the purpose of designing and visualising client projects in which Muze furniture is specified. Resale, sublicensing, redistribution, or use of these assets in any product or marketing material that competes with Muze is strictly prohibited.

11. Privacy and data protection

11.1. We process your personal information in line with the Protection of Personal Information Act 4 of 2013 (POPIA). Our Privacy Policy explains what we collect, why, how we use it, and your rights as a data subject.

11.2. We do not store credit card or banking details. All payment processing is handled by our third-party payment partners on PCI-DSS compliant infrastructure.

12. Disputes and complaints

12.1. If you have a complaint, please email hello@muze.co.za in the first instance. We aim to acknowledge complaints within two business days and resolve them as quickly as we reasonably can.

12.2. If we cannot resolve a complaint between us, you may refer the matter to the Consumer Goods and Services Ombud (www.cgso.org.za) or the National Consumer Commission (www.thencc.org.za) without waiver of any rights.

13. Changes to these Terms

13.1. We may update these Terms from time to time, for example to reflect changes in law or in how we operate. The version in force at the time you place an order is the version that applies to that order.

13.2. We will post the updated Terms on this page with a new “Last Updated” date. Material changes that affect existing orders will be communicated to you in writing.

14. Governing law and jurisdiction

These Terms are governed by the laws of the Republic of South Africa. Subject to clause 12, the parties consent to the non-exclusive jurisdiction of the Magistrates’ Courts and the High Court of South Africa for any dispute arising from these Terms.

15. General

15.1. Whole agreement. These Terms, together with the Returns Policy, Privacy Policy, and any order confirmation, form the whole agreement between you and us regarding their subject matter.

15.2. Severability. If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will continue in full force.

15.3. No waiver. Our failure to enforce any right under these Terms is not a waiver of that right.

15.4. Headings. Headings are for convenience only and do not affect interpretation.
